A technical report showed that Tesla Model X vehicles equipped with the driver assistance system AutoPilot were unable to reliably identify obstacles such as narrow road construction and sometimes applied the brakes unnecessarily, the report said. The Munich court held that the use of AutoPilot could create a “great danger” in the city centre and lead to a collision.

Tesla lawyers have argued that the Autopilot system was not designed for urban traffic. The court in Munich, Germany said that it is impractical for drivers to manually turn on and off the function in different driving environments, which will distract the driver’s attention.
